根據香港法例《刑事罪行條例》(第200章)第161條《有犯罪或不誠實意圖而取用電腦》

有犯罪或不誠實意圖而取用電腦
(1) 任何人有下述意圖或目的而取用電腦 ——
(a) 意圖犯罪(不論是在取用電腦的同時或在日後任何時間)；
(b) 不誠實地意圖欺騙(不論是在取用電腦的同時或在日後任何時間)；
(c) 目的在於使其本人或他人不誠實地獲益(不論是在取用電腦的同時或在日後任何時間)；或
(d) 不誠實地意圖導致他人蒙受損失(不論是在取用電腦的同時或在日後任何時間)，即屬犯罪，一經循公訴程序定罪，可處監禁5年。

(2) 就第(1)款而言，“獲益” (gain)及“損失” (loss)的適用範圍須解釋作不單擴及金錢或其他財產上的獲益或損失，亦擴及屬暫時性或永久性的任何該等獲益或損失；而且 ——
(a) “獲益”(gain) 包括保有已有之物的獲益，以及取得未有之物的獲益；及
(b) “損失”(loss) 包括沒有取得可得之物的損失，以及失去已有之物的損失。

而，誹謗乃發布有關某個人的虛假訊息，令這個人的聲譽受損，就是誹謗。將訊息上載到互聯網，其他登入互聯網的人可以看到訊息，這就是發布。

誹謗不是刑事罪行，但受影響的人（被羞辱或被取笑的人）可以向做錯事的人，提出民事訴訟，向他們要求賠償。

例如以下（圖）

將自己既意思強加於別人的信息內，蓄意曲解別人的信息，並發放於其他已登入互聯網的人睇到既地方，已經可以構成不誠實使用電腦。

起人底者，人（警方）亦可起其底

就算用外國router都可以搵到的。

去到個人私隱，可以直接報私隱專員。亦可即時搵律師要求先屏蔽有關言論，以作適當跟進調查。

至於點解一定叫蓄意？

响互聯網上面、討論區中，如果你冇蓄意打D字、冇蓄意㩒個制，有關既字，係唔會被發放出來，而所有連接互聯網、有關網頁既人都唔會睇到。所以一定見字就係蓄意。

所以我一路都好刻制、只去提有關挑釁、造謠生事者唔好再亂曲解我既意思係咁解。

呢D同大家平時IRL（生活當中）無聊吹水不一樣。請留意。

是否因為嗰D資料唔係佢限嗰D
又或者係網上authorised而來的，如查冊?

否則，除非事主已經authorise個網可以發放佢個人資料，冇可能唔係不誠實取得資料喎。

另一可行之法係民事訴訟對方。

我而家係可以向呢個方向行的。
