1. Ask any one of the security guards downstair to write or sign a simple witness statement to prove that she has already taken statutory holidays (at least to prove some);
2. Arrange the maid to take statutory holidays while she is still serving for your friend and video/audio tape her (w/o letting her know) so that if the maid lied that she was not granted holiday until the last day, your friend can prove innocent;
3. Dont straightly refuse the maid's claim while she is still serving, simply tell her that you need to consult the agent first and will make sure that she can get everything she entitled in the termination payment;
4. One can only claim for at most 6 years entitlement (The Limitation Ordinance (Cap. 347) stipulates that actions founded on simple contract or on tort and certain other actions shall not be brought after the expiration of 6 years from the date on which the cause of action accrued.);
5. Can your friend argue that she has arranged the maid to take statutory holidays on Sundays/Saturdays while the maid voluntarily worked on rest days and rest day pay has already been given to her? Because under the Employment Ordinance, worker can work on rest days voluntarily, but not statutory holidays.
